According to the Affordable Care Act (ACA), an employer who has more than 50 full-time employees, including full-time equivalent employees, is considered an ALE.

Typically, employers will use the employee’s income only (as reported on their W-2) to determine affordability. For most cases, employer sponsored coverage will not exceed 9.5% of this income.

As an ALE, you’re required to offer health insurance coverage to all of your full-time employees. It’s optional to make offers of coverage to your part-time employees. If you opt not to offer coverage to your part-time employees, they can buy health insurance packages from a state or federally supported Marketplace.

Employers with fewer than 50 full-time employees are considered non-ALEs, and they have the option to choose from affordable insurance packages through the Small Business Health Option Program (SHOP).

A copy of Form 1095-B or 1095-C needs to be sent to the IRS and to your health care coverage recipients each year. Form 1094 (B or C) needs to be filed with the IRS along with your batch of 1095 forms. There's no need to send Form 1094 to employees.
For the 2023 tax year, filers of Form 1095-B and Form 1095-C must have copies furnished to their employees/recipients by March 04, 2024. The ACA paper filing deadline with the IRS is February 28, 2024, and the IRS deadline to File 1095-C Online is April 01, 2024.
Yes. The penalty for late or absent filing is determined by when the correct forms are filed with the IRS. This penalty can get up to $250 per return, not exceeding $3 million per year. Additional penalties may be incurred by not sending out recipient copies as well.
